1. Acceptance of these terms

These Terms of Use govern your use of www.buyinthebay.com and our property search site at search.buyinthebay.com (together, the “Site”), operated by Buy In The Bay Realty Group LLC (“we,” “us,” or “our”). By using the Site, you agree to these terms and our Privacy Policy. If you do not agree, please do not use the Site. You must be at least 18 years old to use the Site.

2. What the Site provides

The Site offers general real estate information, property search tools, and ways to contact us. It is for general information only and is not legal, tax, financial, or appraisal advice. Browsing the Site or contacting us does not create a brokerage or agency relationship. That begins only when you sign a written agreement with us. These terms do not change any written agreement you sign with us or any duties that Florida law requires of a licensed real estate broker.

3. Property listing information

Listing information is provided through participating multiple listing services, including My Florida Regional MLS DBA Stellar MLS as distributed by MLS GRID, and their participants. It is deemed reliable but not guaranteed. Prices, availability, square footage, lot size, taxes, flood information, and other property details can change or contain errors, so please verify anything important independently. Home value estimates are not appraisals.

IDX listing information is provided exclusively for consumers’ personal, non-commercial use to identify prospective properties they may be interested in purchasing. You may not copy, redistribute, scrape, or sell it. Listing displays may include additional source, timestamp, and accuracy disclosures required by the applicable MLS.

We follow federal, state, and local fair housing laws and do not discriminate on the basis of race, color, religion, sex, disability, familial status, national origin, or any other characteristic protected by law.

5. Accessibility

We want the Site to be usable by everyone. If you have difficulty using any part of it, contact us using the details in section 16 and we will work to help you.

6. Your account

If you create an account, such as a property search account, give us accurate information, keep your password secure, and tell us if you suspect unauthorized use. You are responsible for activity under your account. We may suspend or close accounts that violate these terms.

7. Acceptable use

  • Do not use the Site for any unlawful purpose.
  • Do not use robots, scrapers, or other automated tools to collect data from the Site.
  • Do not copy, republish, or sell Site content or listing data.
  • Do not submit false information, or information about someone else without their permission.
  • Do not interfere with the Site’s security or operation, or send harmful code.

When you send us information through a form, you confirm it is accurate and that you have the right to share it. We use it as described in our Privacy Policy.

8. Text messages and calls

If you opt in to receive text messages, our Text Message Terms & Conditions also apply. Calls and texts may be tracked or recorded as described in our Privacy Policy.

9. Third-party links and tools

The Site may link to or include third-party websites and tools, such as our property search platform, maps, calculators, and review services. We do not control them and are not responsible for their content or practices. Their own terms and policies apply.

10. Ownership

The Site and its content, including text, photos, logos, and design, are owned by us or used with permission and are protected by copyright and trademark law. You may view and print Site content for your personal use. Any other use requires our written permission. See our Copyright Notice.

11. Disclaimer

The Site and its content are provided “as is” and “as available,” without warranties of any kind, to the fullest extent the law allows. We do not guarantee that the Site or its content is accurate, complete, current, uninterrupted, or free of errors or harmful components.

12. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, or consequential damages, or for lost profits or data, arising from your use of the Site or reliance on its content. Nothing in these terms limits liability that the law does not allow to be limited.

13. Changes

We may change or discontinue any part of the Site at any time. We may update these terms by posting the new version on this page with a new effective date. Your continued use of the Site after a change means you accept the updated terms.

14. Governing law

These terms are governed by the laws of the State of Florida, without regard to its conflict of law rules.

15. General

If any part of these terms cannot be enforced, the rest remains in effect. Our not enforcing a term is not a waiver of it. These terms, our Privacy Policy, and our Text Message Terms & Conditions are the entire agreement between you and us about your use of the Site.
